Terms of Service

The service

Karya Falak is a shared inbox and boards for teams: customer conversations from SMS, WhatsApp, email and web forms become tickets that a team works through, with quotes, invoices and a schedule for those who turn them on.

Accounts

You need to give accurate details and keep sign-in details secret. You are responsible for what happens in your organisation, including what the people you invite do there. Tell us straight away at admin@karyafalak.com if you think an account has been misused.

Your data and your customers

You own the content you and your customers put into Karya Falak. You give us permission to store, process and transmit it only as needed to provide the service. Our Privacy Policy explains how we handle it.

You are responsible for having the right to contact the people you message, for their consent where the law requires it, and for honouring opt-outs. That includes the Spam Act 2003, the Do Not Call Register Act 2006, the Privacy Act 1988, and the WhatsApp Business Messaging Policy and Meta’s terms when you use WhatsApp.

Acceptable use

You must not use Karya Falak to send spam or unsolicited marketing, to break the law or anyone’s rights, to send malware, to get into accounts or data that are not yours, or to overload or disrupt the service. We may suspend an account that does, and we will tell you why.

Other services

Some features rely on other companies: Meta for WhatsApp, Twilio for SMS and email, Stripe for payments, Xero for accounting, Google and Apple for sign-in. Their terms also apply when you use those features. Their charges, such as WhatsApp conversation fees billed by Meta or SMS costs, are yours.

Plans and payment

Prices are in Australian dollars and include GST. Paid plans are billed monthly in advance until cancelled; a cancellation takes effect at the end of the period already paid. If a payment fails we will tell you, and we may limit sending until it is paid. We will give at least 30 days’ notice before changing the price of your plan.

Availability and support

We work to keep Karya Falak available and secure, and we tell you about planned maintenance in advance where we can. The service depends on networks and providers outside our control, so we cannot promise it will never be interrupted.

Ending the agreement

You can stop using Karya Falak and close your account at any time. We may suspend or end an account for a serious breach of these terms, or if the law requires it. You can export your data before an account closes; afterwards we delete it as the Privacy Policy says.

Our product

Karya Falak, its software and its brand belong to us. These terms give you the right to use the service while your account is active, not ownership of it.

Consumer law and liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where the law allows it, our liability for a failure is limited to supplying the service again or refunding the fees you paid us in the 12 months before the claim, and we are not liable for indirect loss such as lost profit.

You agree to cover our reasonable costs from a claim brought because you broke these terms or the law, for example by messaging people without consent.

Changes to these terms

If we change these terms in a way that matters, we will email account owners at least 30 days before the change takes effect. Continuing to use Karya Falak after that means you accept the new terms.

Law

These terms are governed by the law of Victoria, Australia, and its courts can hear any dispute.
